1. End User License Agreement (EULA) & Scope

By downloading, installing, accessing, or activating NovaDash, Llama Server GUI, or any software distributed by 56KLabz, you agree to be bound by the terms of this Agreement. 56KLabz provides both commercial software products and free community tools under the following tier structures:

• Free & Open-Source Software (FOSS / Freeware): Products distributed as free laboratory tools (including Llama Server GUI, Kwota, and open lab utilities) are provided free of charge. Where applicable, underlying source repositories are governed by permissive open-source licenses (such as Apache 2.0). Users are granted full rights to download, run, and utilize these tools on any personal or commercial machine without recurring fees or subscription locks.
• Commercial Standard License ($24.99): Grants perpetual lifetime access for a single individual operator on 1 personal mobile device managing 1 active server/node profile at a time in NovaDash. License seats may be migrated to a new replacement device via account recovery.
• Commercial Power User & Supporter License ($49.99): Grants perpetual lifetime access for a single individual operator across all personal mobile devices and tablets owned by the licensee, managing unlimited server nodes, multi-machine farm hubs, and accessing all advanced tools (custom hotbar editor, macros, webhooks, Gotify, Nuclear Lock™, port forwarding, WOL, and .novabak encrypted backups).
• 7-Day Free Commercial Trial: Fully functional evaluation tier provided for commercial products to verify hardware compatibility, SSH connectivity, and platform performance prior to purchase.

Commercial License Restrictions: For proprietary commercial distributions, you may not crack, tamper with cryptographic licensing tokens, redistribute paid binaries without authorization, or spoof backend APIs. Any signature tampering or unauthorized key duplication automatically and permanently terminates your commercial license.

2. Commercial Purchases, Immediate Digital Delivery & All-Sales-Final Policy

Paid products distributed by 56KLabz are non-tangible, irrevocably delivered digital software goods and cryptographic license keys. 56KLabz provides an unrestricted 7-Day Free Trial for commercial software specifically so every user can test all features and ensure full hardware compatibility on their own devices and servers before making a financial commitment.

STATUTORY WAIVER & ALL COMMERCIAL SALES ARE FINAL: By completing a commercial purchase, you acknowledge and agree that digital delivery of the cryptographic license key and software access is immediate upon transaction completion. You expressly agree that performance begins immediately and you expressly waive any statutory right of withdrawal, cooling-off period, or cancellation under applicable consumer protection laws (including EU/UK Consumer Rights Directives). Once a transaction is processed and a digital license key or download link is generated, NO REFUNDS, CANCELLATIONS, EXCHANGES, OR CHARGEBACK ADJUSTMENTS WILL BE ISSUED UNDER ANY CIRCUMSTANCE. Free community tools and open-source packages require zero payment and are exempt from billing policies.

Fraud & Friendly Chargeback Enforcement: If you initiate a payment dispute, payment reversal, or chargeback without first contacting 56KLabz in good faith, your cryptographic license key, account authentication token, forum access, and IP range will be permanently blacklisted across our authority network, and all active sessions will be terminated immediately. We reserve the right to report fraudulent chargebacks and abuse to credit reporting agencies and fraud-prevention databases.

3. Privacy Policy & Zero-Telemetry Guarantee

56KLabz is built on an uncompromising zero-telemetry, offline-first philosophy. We believe developer and server management tools should protect your sovereignty rather than harvest your metadata:

• No Server Credentials or Payload Collected: We do NOT collect, transmit, relay, or store your server IP addresses, hostnames, usernames, passwords, SSH private keys, terminal logs, or command history. All SSH traffic connects directly from your device to your target servers on port 22 with zero intermediaries.
• Hardware Keystore Encryption: All credentials and private keys saved inside NovaDash are secured on-device using AES-256 encryption backed by the native Android KeyStore / iOS Keychain hardware APIs.
• Account Data Scope: We collect only your registered email address, hashed password, and license activation state strictly for account authentication, billing verification, and license key signing. We never sell, rent, or trade user data.
• Third-Party Payments: Transactions are processed securely through certified PCI-compliant gateways (Stripe and PayPal). 56KLabz never receives or stores your credit card numbers or financial account details.

4. Disclaimer of Warranty & Absolute Limitation of Liability

ALL 56KLABZ SOFTWARE, CODE, BINARIES, SCRIPTS, FIRMWARE UTILITIES, AND WEB SERVICES ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. 56KLABZ DOES NOT WARRANT THAT SOFTWARE WILL OPERATE UNINTERRUPTED, BUG-FREE, OR ERROR-FREE.

ROOT PRIVILEGES, HARDWARE STRESS & OPERATOR RESPONSIBILITY: You explicitly recognize that software built by 56KLabz interacts directly with low-level operating system APIs, raw SSH tunnels, root/sudo shell privileges, and hardware execution layers:

• SSH Command Execution: NovaDash provides client-side terminal and SSH automation. You maintain sole and exclusive responsibility for all shell commands, scripts, cron jobs, file deletions, filesystem modifications, and system updates initiated on any connected server or node. 56KLabz does not monitor, sanitize, validate, or restrict commands sent to your servers.
• AI Inference & Hardware Limits: Tools such as Llama Server GUI facilitate local large language model (LLM) execution, GPU VRAM offloading, and CUDA/CPU acceleration. You are solely responsible for ensuring your hardware possesses adequate power delivery, thermal dissipation, memory bandwidth, and cooling. 56KLabz is not responsible for hardware failure, GPU degradation, thermal throttling, capacitor failure, or power supply crashes.
• Third-Party Models & Upstream Dependencies: 56KLabz does not curate, author, host, or moderate third-party model weights (GGUF, GGML, SafeTensors), upstream open-source engines (e.g., llama.cpp), or remote repositories. Any text, output, inference result, or code generated by models run through 56KLabz software is the sole output and legal responsibility of the operator.

EXCLUSION OF DAMAGES & MONETARY LIABILITY CAP: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 56KLABZ, ITS DEVELOPERS, OWNERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA CORRUPTION, OPERATIONAL DOWNTIME, SYSTEM BRICKING, HARDWARE DAMAGE, WORK STOPPAGE, OR NETWORK BREACHES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR INABILITY TO USE OUR SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY JURISDICTION DOES NOT PERMIT COMPLETE EXCLUSION OF LIABILITY, 56KLABZ’S AGGREGATE CUMULATIVE LIABILITY FOR ALL CLAIMS OF ANY NATURE SHALL BE STRICTLY LIMITED TO THE LESSER OF (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO 56KLABZ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS ($25.00 USD). FOR ALL FREE SOFTWARE, OPEN-SOURCE PACKAGES, AND COMMUNITY BUILDS, 56KLABZ’S AGGREGATE LIABILITY IS STRICTLY ZERO DOLLARS ($0.00 USD).

5. Acceptable Use, Prohibited Conduct & Export Controls

You agree to utilize 56KLabz software strictly for legitimate administrative, developmental, homelab, and computational purposes. You explicitly agree NOT to:

• Use 56KLabz tools to facilitate unauthorized intrusion, denial-of-service attacks, network reconnaissance against unowned infrastructure, or any violation of computer fraud and abuse laws.
• Post or distribute malware, ransomware, weaponized exploits, or unverified root destruction scripts in the Community Forum.
• Crack, decompile, patch, reverse engineer, or redistribute proprietary commercial binaries or cryptographic activation signatures.
• Export, re-export, or transfer 56KLabz software in violation of United States export regulations or international sanctions regimes.

Any violation of this section results in immediate and permanent revocation of all licenses, account access, and forum privileges without notice or compensation.

6. Dispute Resolution, Mandatory Informal Negotiation & Class Action Waiver

Mandatory Informal Resolution: Before initiating any legal claim, action, or arbitration, you agree to submit a detailed written notice of dispute to 56KLabz at [email protected]. Both parties agree to engage in good-faith negotiations for thirty (30) business days following receipt of notice to reach an amicable resolution.

CLASS ACTION WAIVER: YOU AND 56KLABZ AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO COMMENCE, JOIN, OR PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT AGAINST 56KLABZ.

Governing Law & Severability: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. If any provision is deemed unenforceable, that specific clause shall be modified to the minimum extent necessary or severed, and all remaining provisions shall remain in full legal force and effect.
